Operation Hemingway (the London policing operation to support the G8 summit in Northern Ireland)8th~20th June 2013.

Met Police logo

Statement re G8 Demo

In light of the proposed demonstrations by a number of anti-capitalist groups in what has been labelled 'The week of Action' in the lead up to G8 the MPS has been working closely with City of London Police and British Transport Police.

We have sought to engage with protest groups who were proposing action around G8 through our Police Liaison Teams but at this stage no groups or individuals have engaged with us. We would continue to ask anyone who wants to protest in London around the G8 Summit to contact us so that we can work with them and facilitate peaceful protest.

As part of our engagement we have met with key business representatives in Central London and the City to advise them about: how best to prepare their staff, their premises and how to deal with protest in their business premises should it happen.

The pan-London policing plan, Operation Hemingway, combines both dedicated and flexible resources which can be drawn from across London to respond to disorder or incidents should they occur.

At approximately 10:00hrs this morning, officers attended an address in Beak Street, W1 with a search warrant relating to intelligence that individuals at the address were in possession of weapons and were intent on causing criminal damage and engaging in violent disorder. There is no containment.

Today a section 60 and 60AA were authorised and have been in place since this morning in the City of Westminster and the City of London and is based on intelligence around the use of paint bombs and shields against police and police horses. This is ongoing and officers remain at the scene.

A small number of demonstrations have been taking place in Oxford Street and Regent Street and they are currently at Piccadilly Circus.

So far we have made six arrests:

2 x possession of articles with intent to commit criminal damage
1 x assault on police
1 x criminal damage
1 x possession of an offensive weapon
1 x failing to remove a face covering under Section 60AA

LTPH Notice 18/13

Important Changes to the Disclosure and Barring Service (Formally CRB process)
This notice sets out important information that is relevant to all existing and new drivers and operators.

Transport for London (TfL) has been informed that with effect from 17 June 2013 the Disclosure and Barring Service (formed by the merger of the Criminal Records Bureau and Independent Safeguarding Authority) is introducing some important changes to the service it provides.
These changes will have a significant impact on all new and renewal applicants for taxi and private hire driver’s licences.

Applicant-only certificates
We have been advised that with effect from 17 June 2013 the DBS will only issue disclosure certificates to applicants and will no longer send a copy of this certificate to TfL. This differs from the current system where both the applicant and TfL receive a copy of the disclosure around the same time.

The only information that will be provided to TfL directly will be to advise whether or not the disclosure sent to the applicant contained any information or was clear. In the event that we are advised that the disclosure contained information, we will not be provided with details of what this information is.

Therefore, if information has been disclosed to the applicant, we will not be able to make a licensing decision on a new or renewal application until such time as the disclosure has been provided to TfL directly by the applicant. If we are advised that information has been disclosed to the applicant we will write to them directly and ask him or her to send us their original certificate. We will take a copy of this certificate and return it to the driver. As is usual practice and in accordance with DBS requirements, we will destroy our copy once a licensing decision has been made.

As we will not be able to make a licensing decision until we have received the certificate and been able to consider the information disclosed, drivers must respond to our request as a matter of urgency.

If no information is disclosed on the certificate, drivers will not have to take any further action

Update Service
The applicant-only certificate system will be launched at the same time as the new DBS Update Service. From 17 June 2013, anyone who applies for their next criminal record check can choose to subscribe to the new Update Service. This will cost £13 per year in addition to the original disclosure application fee. The Update Service will allow them to keep their criminal record certificate up- to-date so that they can take it with them from role to role, within the same workforce.

The Update Service will allow us to carry out free, instant online checks of an individual’s certificate, to check that it is up-to-date. When someone is subscribing to this service, we will only have to seek a new criminal record check if the DBS tells us something has changed.
Any driver who subscribes to the Update Service will need to provide us with details on their licence application form and confirm that they consent to us carrying out the online check.
We are in the process of developing a system to accommodate drivers who choose to use the Update Service and we will announce further details in due course.

Please note these changes are being made by the DBS and not by TfL. It is one of the government’s priorities to overhaul the criminal records regime to give individuals greater control of their own information, allow DBS Certificates to be reused when applying for similar jobs and reduce the burden of red tape on employers. Please see April’s edition of DBS news for further information or contact the DBS at customerservices@dbs.gsi.gov.uk, 0870 9090811.

RANKS UPDATE 06/06/13

Below is the latest taxi ranks update to help keep you informed, follow the links provided for more information.

News

Finsbury Park
On Friday 7 June and Saturday 8 June 2013 The Stone Roses are playing in Finsbury Park. On both evenings there will be various road closures in place and it will not be possible for taxis or buses to access Station Place from 22:00. Access is expected to be possible from 23:45 but this will depend upon how quickly the crowds disperse.

During the closure a temporary taxi rank will operate in Coleridge Road, in the bus stand and drivers who would normally use the Finsbury Park Station taxi rank can use this temporary taxi rank. This temporary rank will be in operation from 21:00 and during the road closures which are scheduled to bebetween 22:00 and 23:45. Access to this rank will be via Isleden Road.

A second temporary taxi rank for around 20 taxis will also operate in the north west of Finsbury Park, this will also be available from 21:00 and will be accessible from Endymion Road and the Hornsey Gate.

Both ranks will be marshalled and drivers should follow the instructions of the marshals. The concert is scheduled to finishat 22:30 and tickets for both nights have sold out, so there may be a high demand for taxis.

New Taxi rank at Zuma
A new taxi rank has been appointed for Zuma in Raphael Street. The rank is for three taxis and is in two portions, with the first portion directly outside of the door of Zuma.

The rank operates between 18:30 and 08:30. The taxi rank will be closely monitored and it is essential that drivers do not obstruct other vehicles or block the access to the buildings near Zuma, otherwise the rank may have to be removed

Regent Street works
New works in Regent Street are due to commence soon as part of The Crown Estate’s ongoing Regent Street Vision investment programme. The next stage of works will involve widening the footway on the western side of Regent Street between Conduit Street and New Burlington Street.

This works will be done in two phases and during each phase one of the centre of the road taxi ranks between Conduit Street and New Burlington Street will not be available, due to the works extending into the carriageway and traffic being moved into the centre of the road. However, it has been agreed that whilst one rank is suspended the other will remain operational.

Phase 1 of the works is scheduled to starton 8 June 2013 and last for approximately 3 weeks, with phase 2 starting after the first stage is completed and expected to last for approximately 4-5 weeks.

There will be roadside signs and variable message signs (VMS) around the area advising general traffic of the works and to avoid Regent Street where possible. Traffic, congestion and the traffic management arrangements will be monitored.

The aim of the Regent Street Vision is to transform Regent Street into a quality shopping street, a successful business address and a place for people. Some disruption and inconvenience during the works is unavoidable but we will continue to work closely with Westminster City Council to try and minimise this.

More information about the Regent Street Vision can be found on The Crown Estate website here.

Elm Park Fiesta
The Elm Park Fiesta takes place on Saturday 8 June 2013. During the Fiesta the Elm Park taxi rank will be suspended but a temporary rank will be operational in Tadworth Parade.

Events
It has been very busy recently with several events across London so thank you to all of the drivers who worked and helped the public get home safely. The initial feedback is that the We Are FSTVL event in Upminster was well served by taxi drivers and drivers have once again provided a valuable service for The Chelsea Flower show.

Hornchurch

Hornchurch High Street – 24 hour taxi rank
Following several months of hard work Hornchurch High Street re-opened to traffic on Monday 20 May 2013. As part of the scheme to improve the High Street the part time taxi rank that was in Station Lane has been moved to the new bay outside Costa Coffee/Retail Therapy. The new rank will operate 24 hours a day and has been extended to three spaces. This taxi rank will be operational from Monday 20 May 2013 with the old taxi rank in Station Lane revoked at the same time.

The new rank is a working rank for plying for hire from and will be monitored, therefore drivers must not leave their taxi unattended on the rank. The old taxi rank will be used as a bus stand and taxi drivers must also not leave their taxi unattended in this space, otherwise they may be issued with a Penalty Charge Notice (PCN). Drivers must also not park on the pavement outside Ask restaurant.

Loading bays
As part of the High Street improvement scheme Havering Council have also agreed that two loading bays on Hornchurch High Street can be used as taxi ranks between 18:00 and 06:00. These loading bays/taxi ranks are outside the Wimpy restaurant, on the northern side of the High Street, and outside T.E.J. Domestic Appliances Limited Store, on the southern side of the High Street. These new evening ranks will increase night time provision on the High Street but taxi drivers must only use them during the authorised hours of operation.

The loading bay on the southern side of the road will be available from Monday 20 May 2013. The loading bay on the northern side of the road is expected to be available within the next two weeks.

OJ’s bar
Following the closure of Hornchurch High Street TfL, Havering Council, the local police and local drivers agreed that a temporary taxi rank to serve OJ’s bar should be appointed. This temporary rank has worked well during the road closure and the borough have now agreed to further consider providing a permanent taxi rank to serve OJ’s.  Whilst they consider apermanent rank they have agreed to provide another temporary rank to serve OJ’s now that the High Street has re-opened

The location of this temporary rank will be similar to the arrangements previously in place with drivers feeding to the High Street from Billet Lane.  However, with the High Street re-opened drivers will no longer be able to queue across the junction.  The borough have therefore agreed to allow two taxis to wait directly outside OJ’s. The new temporary taxi rank arrangements will be as follows:

-        First portion: Outside OJ’s bar where the dropped kerb is – this portion is for two taxis only and drivers must not block or obstruct buses, the junction or other vehicles.
-        Second portion: Billet Lane, opposite11 Billet Lane, there will be a temporary taxi rank stop showing drivers where the head of the second portion is.
-        Third portion: Also in Billet Lane, again there will be a temporary taxi rank stop showing drivers where the head of the third portion is.
-        Fourth portion: between the entrance and exits of the Queen’s Theatre.

Taxi drivers must follow the directions of the local police and TfL Compliance Officers and must not over-rank or cause any obstructions. The rank will continue to be monitored and following the trial period a decision made about whether a rank can be considered on a permanent basis.

Liverpool Street marshalled taxi rank
The late night marshalled taxi rank in Liverpool Street is continuing to operate on Thursday, Friday and Saturday eveningsbetween 22:00 and 02:00.

London Bridge closure
London Bridge bus station will be closedfrom 01:00 on Saturday 29 June until 05:00 on Monday 1 July 2013 to allow a tower crane to be erected. During the closure the temporary taxi rank arrangements in Tooley Street, which have been used for previous closures, will be in operation. Taxi marshals will also be present and all drivers should follow the directions of the marshals.

Unattended taxis
Unfortunately we’ve received further complaints about taxis being left unattended on the taxi ranks in Hamilton Place and Stanhope Gate. These are exceptionally busy taxi ranks and drivers must not leave their taxi unattended here.  Not only does this prevent other drivers from using these taxi ranks it also damages the reputation of the taxi trade when the public and businesses see unattended taxis on ranks in busy locations.

Our Compliance Team have recently visited these ranks and reported several drivers for leaving their taxi unattended. The Compliance Team will continue to visit these ranks and any driver who leaves their taxi unattended on either of the ranks risks being reported and further action being taken.

Rest ranks for taxi drivers are available at the following locations:

·         Aldwych
·         Arundel Street
·         Eccleston Bridge
·         Great Portland Street
·         Grosvenor Street
·         Hyde Park Street
·         Lancaster Gate
·         Marylebone Road
·         Mathew Parker Street
·         New Bond Street (Clifford Street)
·         Praed Street
·         Russell Street
·         Strand (St. Clement Danes)
·         Lincoln Inn Fields
·         Gillingham Street
·         Charing Cross Road

There are also refreshment ranks at:

·         Cadogan Place/Pont Street
·         Embankment Place (for Northumberland Avenue)
·         Grosvenor Gardens
·         Hanover Square
·         Kensington Road (Broadwalk)
·         Kensington Park Road (Ladbroke Road)
·         Lupus Street/St. George’s Square
·         Russell Square
·         Temple Place
·         Thurloe Place
·         Warwick Avenue
·         Wellington Place

Plus there are taxi meter bays in Palace Street which are reported to be underused.

We know that taxi drivers would like more rest ranks and are looking at suggestions for new rest ranks. One suggestion put forward is to convert the taxi rank in Montpelier Street into a rest rank. If you have any comments on this proposal then let us know by emailingtphranksinterchange@tfl.gov.uk.

Over-ranking
Complaints have continued to be received about taxis over-ranking and queuing on the corner of Hans Road/Basil Street/near Walton Place. This is obstructing other vehicles and causing problems for local residents and businesses. If the taxi ranks serving Harrods are full then drivers must not queue in the road and should move on.

Earlham Street experimental road closure
Following the experimental closure of Earlham Street, Camden Council are now inviting comments on the closure. If you would like to comment on this then you can find contact details for Camden in the consultation leaflet here.

G8 Information Update and Time Line, From Metropolitan Police

Document below is in relation to the G8 Summit and the parallel events taking place in Central London

PROTEST IN BUSINESS PREMISES

1. The rights to freedom of expression (ECHR Art 10) and peaceful assembly (ECHR Art 11) need to be upheld and facilitated - but this does not mean there is a right to enter and remain on shop or private premises for this purpose.

2. There is no freedom of ‘forum’ (i.e. choice of venue) or right of entry to private property for the exercise of the right to freedom of expression.

3. A balance has to be struck.

4. If the protestors could hold their protest somewhere else (e.g. in a public place close by) that would enable them to freely express their opinion, that is likely to be where the balance should be struck.

5. Individuals protesting on private land without the permission of the occupier are likely to be trespassing.

6. A shop owner is presumed to have extended an implied invitation to members of the public to come into his shop for lawful purposes. This implied invitation/permission may be revoked by the shop owner at any time.

7. It is for the shop owner/his security staff to take the first step in any ejection by asking the person(s) to leave. If they do not leave, they immediately become trespassers.

8. Trespass in this simple form is a civil matter. The shop staff may then use reasonable force to eject the trespassers and may ask for police assistance to achieve this in order to prevent a wider breach of the peace breaking out.

9. If criminal offences are committed or threatened (assaults, criminal damage), it is for police to take action to deal with these.

10. In some circumstances there is a criminal offence of aggravated trespass; (i.e. an offence of trespass + action which intentionally intimidates, obstructs or disrupts lawful activity on the premises). Sec 68 Criminal Justice and Public Order Act 1994 creates this offence and police officers can make arrests for it if the offence is made out. Sec 69 Criminal Justice and Public Order Act 1994 gives the senior police officer present power to direct those committing, or intending to commit, aggravated trespass to leave the premises and the trespassers commit another criminal offence if they do not leave.

Government Spend £144,698 on London minicabs.

                     MARIA EAGLE (Lab)                                     DAVID LIDINGTON(Con)

Maria Eagle (Garston and Halewood, Labour)
Asked the Secretary of State for Foreign and Commonwealth Affairs how much his Department spent on ministerial travel by (a) Government Car Service, (b) private hire vehicles, (c) taxis, (d) rail, (e) aviation and (f) other means in each year of the current parliament.

Hansard source (Citation: HC Deb, 3 June 2013, c865W)

The question was answered by David Lidington (Minister of State (Europe and NATO), Foreign and Commonwealth Office; Aylesbury, Conservative)

Details of ministerial overseas travel are published quarterly in line with the Ministerial Code. The most recent FCO returns can be found at:

https://www.gov.uk/government/organisations/foreign-commonwealth-office/series/minister-data

Earlier returns can be found at:

https://www.gov.uk/government/publications/data-set-of-quarterly-returns-by-ministers-special-advisers-and-the-permanent-under-secretary

Departmental spend on the Government Car Service for ministerial travel is published in an annual written ministerial statement by the Department for Transport. Figures for 2010-11 were published on 16 January 2012, Hansard, columns 30-31WS, and for 2011-12 on 20 December 2012, Hansard, columns 126-128WS. Details of the costs for 2012-13 will be published in the normal way later this year.

Additionally, in 2010-11, the FCO spent £76,936 through FCO Services on the London Car Service. In 2011-12 this spend was £148,850 and in 2012-13 £144,698. The FCO moved from using only the Government Car Service to using the London Car Service (run by FCO Services) in September 2010.

Taxis are only used for ministerial travel in exceptional circumstances, where the Government Car Service or London Car Service is not available. To collate information on spend would incur disproportionate cost.

Section 10 of the Ministerial Code provides guidance on travel for Ministers and makes clear that Ministers must ensure that they always make efficient and cost-effective travel arrangements.

NEW DRIVERS LICENSES AND IDs PROGRAM TO BE RESTARTED SOON.

Notice 10/13

Transport for London London Taxi and Private Hire

London Taxi Drivers - New Design Licences and Area Identifiers

Further to TPH Notice 07/13, regarding the new design licences and area identifiers issued on 12 February 2013, this notice provides taxi drivers with an update on our plan to re-issue all taxi driver licences and area identifiers.

As was set out in TPH Notice 07/13, in order to re-issue taxi driver licences it is imperative that those drivers who were requested to provide passport sized photographs do so without delay. We would like to thank all the drivers who have already done this.

Unfortunately there are still a significant number of taxi drivers who have not provided their photographs and any driver who has not yet responded to this request is required to do so without further delay.

Photographs can be emailed to TPHphotos@tfl.gov.uk or posted to:

Taxi Driver Photographs 4th Floor, Green Zone Palestra
197 Blackfriars Road London SE1 8NJ

Given the volume of drivers that are still required to provide photographs, the bedding-in period of the new vehicle licensing service and the ongoing development of the new system for driver and operator licensing, we have decided to reschedule the issue of the replacement taxi driver licences and area identifiers.

This programme of work will be restarted as soon as possible and a further announcement will be made in due course.

Thank you for your understanding and assistance.
