G8 Information Update and Time Line, From Metropolitan Police

Document below is in relation to the G8 Summit and the parallel events taking place in Central London


PROTEST IN BUSINESS PREMISES

 

 

 

1. The rights to freedom of expression (ECHR Art 10) and peaceful assembly (ECHR Art 11) need to be upheld and facilitated - but this does not mean there is a right to enter and remain on shop or private premises for this purpose.

 

2. There is no freedom of ‘forum’ (i.e. choice of venue) or right of entry to private property for the exercise of the right to freedom of expression.

 

3. A balance has to be struck.

 

4. If the protestors could hold their protest somewhere else (e.g. in a public place close by) that would enable them to freely express their opinion, that is likely to be where the balance should be struck.

 

5. Individuals protesting on private land without the permission of the occupier are likely to be trespassing.

 

6. A shop owner is presumed to have extended an implied invitation to members of the public to come into his shop for lawful purposes. This implied invitation/permission may be revoked by the shop owner at any time.

 

7. It is for the shop owner/his security staff to take the first step in any ejection by asking the person(s) to leave. If they do not leave, they immediately become trespassers.

 

8. Trespass in this simple form is a civil matter. The shop staff may then use reasonable force to eject the trespassers and may ask for police assistance to achieve this in order to prevent a wider breach of the peace breaking out.

 

9. If criminal offences are committed or threatened (assaults, criminal damage), it is for police to take action to deal with these.

 

10. In some circumstances there is a criminal offence of aggravated trespass; (i.e. an offence of trespass + action which intentionally intimidates, obstructs or disrupts lawful activity on the premises). Sec 68 Criminal Justice and Public Order Act 1994 creates this offence and police officers can make arrests for it if the offence is made out. Sec 69 Criminal Justice and Public Order Act 1994 gives the senior police officer present power to direct those committing, or intending to commit, aggravated trespass to leave the premises and the trespassers commit another criminal offence if they do not leave.
